Escaping Domestic Violence

People often talk about domestic violence as though it is a problem that happens to other people. In fact, it's a frighteningly common problem, and one that leads to injury and worse at all levels of society.

It's all well and good to talk about social problems, but when domestic violence happens to you, what can you do? How will you protect yourself?

Being wrongly accused of domestic abuse, sometimes to obtain a perceived advantage in a custody or other case, is also a very serious problem.

At Herbold Law PC, we help many people who have been subject to domestic abuse or are accused of domestic abuse. We have experience with such matters as:

  • Temporary protective orders
  • Protective orders
  • Domestic abuse hearings
  • Emergency relief

Iowa's Domestic Abuse Law

Iowa law uses the term "domestic abuse," rather than "domestic violence," and defines domestic abuse as an assault between family members, separated spouses, parents of a child, former household members and people who are currently or were once in an intimate relationship.

It's important to note that a threat alone can constitute abuse. Unlike many aspects of the law, domestic abuse law is concerned not just with crime and punishment, but also with prevention.

Abuse within a domestic relationship often gets worse, unless the abuse is stopped. That's why it's important to seek out help as early as possible.

Protective Orders

One of the best things you can do to protect yourself or your vulnerable loved ones is to seek a protective order. This is a way of keeping the abusive person away from the vulnerable people. If the abuser violates the order, he or she may be subject to immediate arrest.

Our attorney helps people request protective orders from a judge and then protects our clients' rights at hearings and other proceedings.
